They are not getting paid. All officers are fired except Clark. He’s acting chief at this time. I see malfeasance in office in someone’s near future. Just takes a lil more time. Ask the mayor that. Clark is so low down it makes me wonder if he sabotaged his wife’s car. Has resorted to some very low tactics.

How many lies can the police tell???

So just when we thought the Rapides Parish Sheriff’s Office was all out of lies they managed to come up with a few more…

This is the response I received from Lt. Keith Perkins a month after my FOIA request had been sent (I mailed it March 7th, 2016). This response is to an email sent April 6th, 2016: (our rebuttal will be in blue)

1.       You have the majority of the file already.

No, we do not, Lt. Carnline stated that this file was over 2 inches thick two years ago. I received 91 pages which is less than 1/2 inch. So, no we do not have a “majority of the file already”.

2.       At the time we only used cassette recorders and you have the typed statements from those recordings.

Within the March, 2006 investigative report from Det. Stephans, it states “Audio CD from Lt. Bordeleon when he first arrived on scene was included with the file”. So no you did not use cassette recorders, in fact I am pretty sure you used digital voice recorders that were transferred over to CD. But there is proof that audio CD’s do exist in this case.

3.        I am supplying you with the photos I received from crime scene detectives.

I do hope that these are copied on a CD as I requested in my FOIA request and not the darkened black and white copies that were sent to the family.

4.       There were no in car camera’s used in 2005 nor do I see anything concerning patrolman, “ Westley Clark”

First, I had to correct the name of the patrolman from Westley Clark to Wayne Clark, but since Lt. Perkins has formally acknowledged this via email, I will be sending another FOIA. As far as “in car camera” this is also a lie on the part of Lt. Perkins because the same March, 2006 report from Det. Stephan’s states “due to positioning of the vehicles, the video could not be obtained”. However, this does not clarify where the video from the call to the home of Leslie Clark’s mother is or if it had been obtained for this investigation.

5.       There is no mention of 911 recordings or calls in the file and no EMS reports either.

This one is very interesting for the fact that during that same “Audio CD” of Lt. Bordeleon’s initial arrival at the scene (that was sent to us via the Attorney General’s office last week) we can clearly state that the EMS report will be sent upon completion to include in the case file. In fact, they left the leads on Heather’s body and took photographs to “cover all basis” when it came to this case. So you mean to tell me that during a criminal investigation you did not collect the 911 recordings (to judge the demeanor of the caller) nor the EMS report (to gain information that may have been told to them while they were at the scene)?? Well, if you had maybe you would have noticed the lies that where told by Michael Skarina to the EMS personnel, because we were able to obtain it and we know the lie he told. In fact this lie was proven to be incorrect information by a police report that was written by the same Officer Wayne Clark who we are asking about the in car video information. Oh one more thing, did you question Officer Clark about his dealings with the victim prior to her death?

6.      We did not videotape interrogation interviews in 2005.

Oh, Lt. Perkins, the next time you choose to lie to someone, make sure it is not someone who does their homework first. Look up STATE V. McCARTNEY (No. 96-58)  http://www.leagle.com/decision/19961100684So2d416_11023/STATE%20v.%20McCARTNEY . Lt. Perkins is that not you when you were a detective listed in this Appeal ….

“Defendant claims Detective Keith Perkins of the Rapides Parish Sheriff’s Office made certain promises regarding protection for his girlfriend and family in exchange for him making the statements. Detective Perkins testified that he did not make any such promises. Defendant asserted at trial that during his videotaped confession he asked for protection for his girlfriend and loved ones several times, and Detective Perkins replied, “okay.”

We are reading that official court document correct, this case is from 1995, so tell us again how you did not have videotaped interrogation interviews because anyone who clicks on the link above will see that this case is largely because the suspect says his videotaped interrogation was done prior to being given his rights because of a conflict in the time differences. Regardless, Lt. Perkins, it shows you to be a liar again.

Lt. Carnline sent me a part of the case file citing the 10 year rule. The 10 years have now past and I would like a more than the 91 pages that were sent to me in the past. He also did not include any of the photographs, any copies of the recorded conversations/interviews, any video recordings nor did he send any copies of the EMS reports nor a copy of the 911 call.

Sir, with all due respect, even Heather’s family has requested a copy of the entire file only to be denied. At one point the photographs that were sent to Heather’s brother Hunter were of such poor quality (darkened black and white copies) that when Hunter first looked at them he thought his sister had been dismembered.

Since the 10 year rule no longer applies, I will again state that I am requesting the entire case file as per my letter dated March 7, 2016. Please let me know the cost of this so I can get it out to you to cover the expenses.

Lt. Carnline instructed me two years ago that the file was over 2 inches thick, I received 91 pages which is less than a half an inch. So I do not have a “majority of the case file”.

I am requesting the case file in its entirety. That is copies of all audio tapes (this can be done as it has been for years in cases where cassette has been transferred to CD for court presentation). This is to include the audio of Carl Bordelon as mentioned in his report, both the interrogation interviews since various items were noted to be “inaudible” I can have someone clear the tape up to make the audio clearer if you are unable to do so.

I will make the correction now as to the dashcam video of officer Wayne Clark not “Westley Clark” as stated in my request on March 7th, or if you would like I will provide another official FOIA request for this. If you do not have video I would like to know the date that video was placed in the vehicles in your department.

All cases of death outside of a medical facility or the direction of a doctor are to be treated as a homicide unless proven otherwise, so how can there be no recordings or transcripts of the 911 calls that were made on the morning that Heather’s body was not found.

Where are the results of the sexual assault kit, this was listed in the autopsy report yet the results from that test are not there. Please do not tell me that the detectives on this case took the word of someone who was supposedly to be re-interviewed as a suspect word for consensual sex?

If you want me and my repeated request to go away and you want to “bring a close to this matter” then release the entire file with all audio/video/logs/photographs and other evidence that was collected in this case. Then I will no longer send request to your department in reference to this case. Since your department has deemed this case closed due to suicide there should be no issue with my request.

You will have to excuse my brash tone, but for two years I have been requesting and for over 10 years the mother of Heather has been requesting this file.

First of all, I have no problem releasing what you are entitle to, according to Public Records Act, you are not entitle to the entire case file because it contains medical information that is covered by the Public Records Act.  I will provide a list of what I am not releasing.  I will have to find the cassettes used to record the statements in this case which will take some time. Thank you for your email. I would like to direct your attention to Det. Stephans report, he states that there is an “audio CD” of Lt. Bordelon’s conversations when he first arrived at the scene. So this would lead me to believe that the interviews are on CD and/or video if your department video taped the “interrogation interviews” like most other departments. Then I would further direct your attention that further in his statement he says that “in-car video of the events that happened along Hwy 165 were not available due to the positioning of the vehicles”, which would also lead one to believe that the same officer Wayne Clark had in car video of the disturbance call at the home of Leslie Clark’s.

I have the 911 call center log, as well as the EMS report from Acadian, but if you have the audio of those calls or at least acknowledge if they are in the file so the family may request them.

My frustration is at the fact that Lt. Carnline quoted a rule to me in December, 2014 LSA RS 44:3 F, knowing it was going to be obsolete in 2015. My frustration is that your office has released the autopsy report yet myself nor the family has ever received a copy of the coroner’s report.

Please understand that the frustration is not directed at you personally. I would like to ask another question, there is concern from Heather’s mother as to the whereabouts of her clothing she was wearing when she was found. Can you tell me if there is an evidence box on this case and if the clothing items are located in that box so I may relay this information to her mother.

I just spoke with former detective Stephan and I asked him your questions as they pertained to his investigation.  He told me that if he put that (video) in his report, then he submitted the CD in question to the district attorney’s office.  I can tell you that it is not in the file I have.  Our department did not video interrogations until approximately 3 years ago.  In 2005 we audio taped interviews and interrogation only.   As far as other recordings, I will check other avenues in an effort to locate those.  In regards to LSA RS 44:3 F, I will research this as I am not totally familiar with this at this moment.  You say that my office has released a copy of the autopsy report but you don’t have a copy of it, who did we release it to?  Please know that I am sympathetic with your frustration and will do my best to accommodate as many of your request as possible.

There was a police report less that 24 hours old yet no one thought anything of this FACT?

Bottom line Mr Perkins. I AM AGAIN REQUESTING THE RELEASE OF the COMPLETE CASE FILE. INCLUDING ANY AND ALL EVIDENCE.
My daughter’s belongings didn’t just disappear into thin air.
I have asked repeatedly since the day my daughter’s body was found in that house.
It’s been 11 years and I’m still waiting on answers and I’m NOT GOING AWAY.

Well, then we are going to have a problem with evidence, because according to Det. Stephan’s report, the “investigative file is being submitted for review by the Office of the Louisiana Attorney General to determine whether or not any prosecutable criminal offenses exist. It is my understanding that due to a potential conflict involving the back child support issue the Rapides District Attorney has been recused from handling this matter.”

That is a direct quote from his report dated March 19, 2006. The AG’s office says they only received 227 pages from your department and they have sent me all 227 pages they had in the file, so there is clear evidence in this case that is missing somewhere.

I said that your office released the autopsy report, that is different from the local coroner’s report. The coroner’s report is what the local coroner, Marcus Blakeley, would have written since he is the one that was on scene and the one that transported her body from the scene.

Det. Ribaudo’s “supplemental report” is a joke at best as no one who was a qualified Crime Scene Investigator would have such a non-detailed report in the file. The fact that Ribaudo listed this crime as a “suicide” without toxicology reports and further examination of the evidence is beyond me, but on his trip report he did just that.

The fact that there was a sexual assault kit performed yet the results have not been released and every time the question is asked it is ignored. Lt. Perkins, imagine this was your daughter, she ends up dead in her estranged mother’s home. You have medical documents from her personal doctors stating she had zero contact with her mother and an outright hatred for her. This is what her mother is dealing with.

Heather had no contact with Michael Skarina, she was getting ready to file a back child support judgement against him, she ended up dead at his home by a drug that was prescribed to him. You are told your daughter had consensual sex with a stranger because that is what he said, yet there was a rape kit done on her at autopsy. Your told she went out drinking yet no alcohol is in her system. The police expect her mother to believe that she showed up at Michael Skarina’s house without her car, did not tell her job she was leaving, did not cancel doctors appointments that were made within a couple of days of her being seen in Louisiana, called three different people to ask them to come get her from Michael’s house because he would not take her back to Mississippi and the list goes on.

The mother only wants answers and if the end result is the same at least she would have had a chance to see it all for herself. But at this point she has been fed one line after another so she is clearly upset that she is being denied the chance to have an independent person look at the file.

So as you can see yes we are frustrated and all we want is a chance to get the file so we may review it ourselves and see if we come up with the same conclusion or not.

Is it routine to split up a case file & it’s attachments and put it in random places?
You’ve told us that this file was off site previously and you retrieved it. Yet now the file is again off site?
This is getting rather tedious don’t you think?
For one time could someone please not give us half information? Drag us for weeks with ridiculous excuses as to why you can’t or won’t do your job?

I certainly hope your week of training included how to fulfill a records request properly & in a timely manner.

Frankly, I’m tired of this run around.
Your weekly emails putting us of another week every week are a tad boring now.

This request should have been fulfilled by now according to Louisiana State law.

I still do not understand the reason for all this unless there is something to hide.

This case was closed. I’ve repeatedly requested this file since day ONE & now for over 10 years.
Yet, here I am still begging for information on HOW MY DAUGHTER DIED IN YOUR STATE WITHOUT A REAL INVESTIGATION?

I again ask that you please fulfill this repeated request and stop regurgitating the same line, “It’s off site”.
We were told it’s been within your office for well over 2 years, so please stop insulting my/our intelligence.

I look forward to receiving this file in its entirety before month’s end.

Under the Louisiana Public Records Act § 44:1 et seq., I am requested an opportunity to obtain copies of public records that pertain to the death of Heather Renee Skarina from the Rapides Parish Sheriff’s Office. She was found deceased at 306 Powell Drive, Apartment 36, Ball, Louisiana on or about September 18th, 2005. Since this case has been deemed closed it falls under the protection of the Sunshine Law that allows all of the items below be released as per my request.

I am formally requesting the following:

  1. The entire case file.
  2. Copies of any and all recorded, both video and/or audio interviews with witnesses and suspects please provide these on CD or high definition audio tape.
  3. Copies of any and all photographs at the scene. Please provide these in high resolution color prints or on a CD.
  4. Copies of any and all video recordings from the law enforcement vehicle that had any dealings with Heather Renee Skarina 72 hours prior to her death and any video recordings from any law enforcement vehicles that arrived at the scene of her death. Her encounters would have been with Patrolman Westley Clark.
  5. Copies of the 911 call made to request assistance to Heather’s unresponsive body being found.

Where is the Evidence Box???

Leyona has asked this question for 11 years, no one can tell her where the evidence is located. I have asked the question to Lt. Keith Perkins and every time he ignores responding to the question. Leyona has tried contacting the funeral home, the coroner’s office, the North Louisiana Crime Lab and the Louisiana State Police only to be told “we do not have it” or “we cannot say if it is here or not without a court order”.

We have questions:

  1. Where are Heather’s clothes that she was found in?
  2. Where are the results to the sexual assault kit that was performed at her autopsy?
  3. Where is her jewelry?
  4. Where are the crime scene photos?
  5. Where are her autopsy photos?
  6. Where is the complete autopsy report with diagrams?
  7. Where are the pill bottles collected?
  8. Where are Michael Skarina’s cell phone records?
  9. Was there a home phone? Where are those records?
  10. What was on the clip board?
  11. Where are the interviews with Patrolman Wayne Clark (the last person other than Michael to see Heather alive)?
  12. Who is Matt Davis? Where is his interview/statement?
  13. Who is Jeff? Where is his interview/statement?
  14. Why did you not secure Heather’s apartment in Mississippi as a crime scene and have it processed?

These are not the only questions, but it is a good start on getting some answers….

We see more specific FOIA request heading in Louisiana’s direction…. STAY TUNED!!!

Then there was a time for rest….

Well, there came a point where we did this mass twitter blitz trying to get the attention of someone, but like everything else in this case we hit a brick wall. We decided that we needed a break, Leyona had to decompress and I had to get ready for our big retirement move. Although Leyona and I talked often about different things regarding the case, we felt that we had to step back and regroup. Maybe this was good for us because we started back up after the new year and man have we started to get somewhere. The new information we have learned over the last couple of months is enough to prove that Heather Renee did not commit suicide, but we have found some interesting information out on the people involved in the case and those who were around Heather during the last few days of her life.

Dealing with the Louisiana Attorney General’s Office

So by January 14, 2015, I had enough of this 91 pages of incomplete information. I sent the following to the Criminal Division of the Attorney General’s office:

Under the Louisiana Public Records Act § 44:1 et seq., I am requested an opportunity to inspect or obtain copies of public records that pertain to the death of Heather Renee Skarina Skeen from the Rapides Parish Sheriff’s Office. She was found deceased at 306 Powell Drive, Apartment 36, Ball, Louisiana on or about September 18th, 2005. I have included a copy of the request sent November 24, 2014.

I included a check in the amount of $42.50 as per the fee listing on the Sheriff Departments records request website. I was contacted by Lt. Carnline that the file was over 2 inches thick and he would have to contact the District Attorney. He sent me a total of 91 pages, even after I told him I would send additional funds.  After receiving the records I sent him a follow-up email, this is also included in this letter. For a file that was “over 2 inches thick” to be reduced to 91 pages is what I am questioning.

This case was deemed a “suicide” at one point Lt. Carnline tried to invoke the 10 year rule but that is where the problem lies. When a record is 10 years old and deemed a “suicide” the records are destroyed. I am wanting to obtain these records before they are destroyed as there are many unanswered questions to this case and we are working to find the answers to those questions.

I have been informed that former Attorney General Paul Knight was looking into the case at one time. I would like to know if there is any information in the criminal division that could be of use in this case. I will be more than happy to provide you with what they say are “Carl Bordelons Report”, “Investigation notes/reports”, and the letter from the “State Police Request”. These did not answer all of my questions in my email dated December 16, 2014 and the above mentioned “reports/request” contained very little information.

There was more to this case than just a “girl committing suicide” none of the information given to law enforcement was indicated in any of the reports. Heather was talking to an attorney in Mississippi about filing for back child support against her father Michael Skarina a mere three weeks before her death. Heather made this information known to her paternal grandmother during a phone conversation. There was a witness that noticed someone carrying a person out of the building Heather lived in Mississippi the night that she “supposedly” left Mississippi. There was an unidentified puncture wound on her arm found during the autopsy that was never looked into.

We are not asking you to re-investigate this case at this time, we are just requesting that the complete file on Heather Renee Skarinas’ death be released in full so we may conduct our own private investigation into her death.

Okay now really, what if any records???? Did your office not have a meeting with members of this family and in this meeting did you not bring in a file that was over 6 inches thick? Was your office not given the referral from someone from Rapides Parish for Grand Jury consideration? I do believe you were because those documents were included in my FOIA request and these are the first two pages of the documents that were sent to me in that file.

So can you please explain to me how you can send me a letter that states “our office is in the process of determining what, if any, records are subject to this request.”

About two weeks later they did send me 227 pages of well, just about junk. However, they did include the re-interviews of Michael Skarina and Leslie Clark. What I found disturbing is that at this time I am complete stranger to the family and the Attorney General’s office sent me the non-redacted tax returns of family members in this case. I am not sure what these departments keep saying they have to redact from the file when they are giving out all kinds of sensitive information. Even this 227 pages is a far cry from the 6 inches that was sitting with Butch Wilson during a meeting with Heather Renee’s grandmother. So we continue to request and continue to get a little more each time.

Lt. Carl Bordelon’s Incident Report dated 09/18/2005

This has a brief narrative on it so I am going to post my comments after I quote it.

Officer Narrative states:

“Lt. Bordelon was dispatched to the residence of 306 Powell drive Apt #36 in regards to a medical emergency of a subject not breathing. Upon arrival Officer was then confronted at the front of the residence by Mr. Skarina who was advising his daughter Heather was not breathing requesting medical assistance. Officer then located subject at the back right area master bed room lying on the floor on her right side having a small amount of blood on her face and hands. Subject was observed to be un responsive in addition to being cold to the touch and stiff ( Rigor Mortis ) in addition to checking for vital signs observing non. Complainant in addition to witness was then asked to remain outside of the residence in regards to preparation of a Crime Scene. Upon arrival of Detective Mike Stevens and Crime Scene Investigator Detective Tom Ribaulo with Rapides Parish Sheriff Department investigation was then continued by them. ( See Attached Photos )”

  • There were no photos in this 91 pages of information sent to me from Lt. Carnline as per my request.
  • I would think that there would be more to this report then just this brief statement. If I were the first officer on the scene, I would document as much as to what I saw, heard or witnessed from those in the home as much as possible. There is none of this in this report or located anywhere in the 91 pages.
  • Here Bordelon does state that Ribaudo is the “crime scene investigator”. So this leads to the questions raised from his report or lack thereof a report.
  • The Accidental or Natural Death Report differs from Det. Stephan’s account that Heather’s last doctor’s appointment was September 1st, 2005. This report states her last appointment was September 7th, 2005 and this contradicts the statement from the doctor’s office.

Again anything in “quotations marks” is directly from the report no typos from me nor ad-lib.

I am just sitting here shaking my head at this point.

  1. Paragraph one states: “At approximately 10:56 a.m. on 9-18-05, I was advised by Deputy Rogers of a death at 306 Powell Drive #36, Pine Trace Apats. In Ball, La. I departed my work station and arrived at the location at approximately 11:27 a.m.”
  • Okay not so bad to start.
  • Who is Deputy Rogers? Works with Ball Police Department? Rapides Parish Sheriff’s Office?
  1. Paragraph two states: “I entered the residence and observed a W/F laying on the floor in the rear bedroom. Victim was identified as Heather Skarina, DOB/7-8-83. She was laying on her right side and wearing brown shirt, tan pants, no shoes or socks present. There was also found a small amount of blood on the carpeted floor about 6” from victim’s left elbow. Found no signs of trauma to victim’s body, head or face area.”
  • There is no description of the residence?
  • There is no description of where exactly the “rear bedroom” is located? Is it straight back from the front door? To the left? To the right?
  • Where on the floor in the bedroom was she? By the bed? By the door? Next to the nightstand? The dresser?
  • Who moved the body to look for trauma? You? Stephan’s? EMS? Michael Skarina?
  1. Paragraph three states: “A search of the area revealed some medications that were found and collected for possible toxicology testing?”
  • This is somewhat answered below, but I do have a couple more questions here.
  • Where were these found?
  • Are these the only prescriptions or medication in the home?
  • Who had access to these medications?
  • Is there any leftover food or beverages in the room?
  • How many medications were there collected?
  • How many medications were in the home in total?
  • Who all had legal prescriptions for these medications?
  1. Paragraph four states: “A medication report was completed and attached.”
  • This only list three prescriptions and only two of them are dispensed to Heather, the third was a sample pack and it was not listed in the medications from the doctor’s office notes.
  1. Paragraph five states: “At approximately 12:12 p.m., Marcus Blakely arrived and took control of the victim. She departed the residence at about 12:33 p.m. 9-18-05.”
  • There is nothing to say here.
  1. Paragraph six states: “No other action taken pending toxicology results.”
  • Whoa, wait a second.
  • Where are the pictures?
  • Where is the drawing diagram of the inside of the residence?
  • Where is the drawing diagram of the bedroom the victim was found in?
  • Where is there evidence collected at the scene?
  • Did you check the garbage for possible other medications?
  • Did you take anything belonging to the victim as evidence such as her purse?
  • Where are the complete notes about your investigation inside the residence? This seriously cannot be the end of your report?
  • You are the Crime Scene Investigator, right?

I do not know what to say, I am stunned that this is the report from the “crime scene detective”. All I have to say is wow, Louisiana, it is a wonder you can solve anything if this is what your detectives do at a scene.

Now I have questions on these trip report sheets.

  • You have that you left the scene at 12:05 PM. You left before the coroner came? But wait…
  • You have on the other form that you wrote that the coroner arrived at 12:12 pm and you were in service to Cabrini Hospital.
  • How can you know what time the coroner arrived if you departed the scene 7 minutes earlier?
  • You did not take Heather’s purse at this time according to this paperwork. Why?
  • Who is Matt Davis?
  • Where are your photographs?
  • You did not collect evidence from the carpet that held the blood around the victim? Why, how do you know if it was combined with dried vomit or not?
  • There was no other evidence collected at the scene except for three medication bottles?
  • Why have you ruled this a suicide already?
